Rental Agreement Terms and Conditions
Please Read This Rental Agreement Carefully
1. Rental Agreement: Stagebackdrops agrees to rent the product to Renter, and Renter agrees to rent the product from Stagebackdrops, pursuant to the terms of the Rental Agreement for the Rental Period. By signing this contract, Renter agrees to rent from Stage Backdrops the product listed for the price and length of time indicated on the contract subject to the following terms and conditions. Rental Agreement must be signed and dated before any backdrops are shipped.
2. Rental Term: The lease will start on ____________________(begin date) and will end on______________________(end date).
3. Rental Payments: Renter agrees to pay to Stagebackdrops as rent for the product the amount of $250 (Rent) per week for one (1) item.
4. Cancellation: Orders cancelled less than 14 days prior to the scheduled date of shipment $100 (fee). Orders cancelled more than 14 days prior to the schedule date of shipment $50 (fee).
5. Shipment and Return: All backdrops are shipped from Stagebackdrops's warehouse in Tampa, FL . If Renter has an existing account with UPS or other carrier, Stagebackdrops can ship with the carrier of Renter's choice. Stage Backdrops also need to know who will receive the order (the person or shipping agent in charge) and the exact address where they will accept the order. Renter is also responsible for returning the order back to Stagebackdrops by Renter's contract return date. Return the shipment to the appropriate warehouse for the item(s) rented shown on the label affixed to the inventory.We are not responsible for lost return labels if we can prove Return Service Receipt.
6. Late Returns: The fee paid for the rental of the backdrop is for the duration of the rental period only. Any period in excess of the agreed rental period will result in a charge of forty dollars ($40) per day, per one item.
7. Use and Maintenance: Renter shall maintain stage backdrops in good operating condition, allowing for reasonable wear and tear. Backdrops can be used only in a careful and proper manner. Stagebackdrops's stage backdrops are designed to be used indoors only.
8. Inspection: Renter shall inspect the product within two (2) days after receipt thereof. Unless Renter contacts Stagebackdrops to report damage within that time, specifying any defect in or other proper objection to the product, Renter agrees that it will be conclusively presumed that Renter has fully inspected the product and acknowledged and that Renter has accepted the product in that good condition and repair and that the product is in good condition and repair and Renter is satisfied with the product.
9. Indemnity: Renter agrees to indemnify and hold Stagebackdrops harmless against all claims and costs (including reasonable attorneys' fees and cost of defense) associated with Stagebackdrops's rental, use, operation and possession of the product.
10. Blanket Rental Agreement:
From time to time on a continuing basis, Stagebackdrops will rent the Products to Renter. As to each and all such products rented by Renter, Renter agrees to be bound by all of the terms and conditions of this Agreement.
For each rental, the following items shall be specified on your order:
a. Term of the rental.
b. Description of the Product.
c. Rental rate.
d. Item condition.
11. Loss or damage to product:
Renter assumes complete responsibility for renting stage backdrops and agrees to fully reimburse Stagebackdrops for loss or damages incurred during the term of rental. Renter shall alert Stagebackdrops to any damage to the products. Renter shall be responsible for the replacement cost value or repair cost of the product, whichever is less. The full replacement value will be charged in addition to the rental fee. Renter is not permitted: to staple, tack, pin, glue or hang drops in any manner other than with the provided tie lines.
